1. Introduction

Welcome to KlarVPN. These Terms & Conditions form a legally binding agreement between you and KlarVPN, governing your access to and use of our virtual private network services, website, mobile applications, and related software or features.

By creating an account, downloading our application, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Eligibility and Account Registration

• You must be at least 16 years of age to use the Service.
• To use the Service, you must create an account by providing a valid email address.
• You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
• You may not register more than one free account without our prior written consent.

3. Service Description

We strive to maintain high uptime, but we do not guarantee uninterrupted, error-free, or 100% available Service. We may modify, enhance, or discontinue features of the Service with reasonable notice for material changes.

• A dedicated encrypted tunnel, or a dedicated encrypted tunnel paired with a dedicated IP address where available.
• A live Transparency Dashboard displaying the sole data metric we retain: your usage.
• A tunnel refresh feature that destroys your current tunnel and provisions a fresh one.
• Always-on Kill Switch and Auto-Connect functionality.
• Access to our global network of servers.

4. Plans, Pricing, and Payment

All plans include the dedicated encrypted tunnel, Transparency Dashboard, Kill Switch, and Auto-Connect features. Paid subscriptions renew automatically unless you cancel before renewal. Refund requests should be sent to support@klarvpn.com within 7 days of initial purchase or renewal.

5. Acceptable Use Policy

You may not use the Service for illegal activities, fraudulent or deceptive conduct, intellectual property violations, harmful software, security violations, network abuse, spam, cryptocurrency mining, harassment, resale, or facilitating violations by others.

You are responsible for violations by anyone using your account, whether with or without your permission.

6. Enforcement

• We may investigate suspected violations or misuse of the Service.
• We may suspend or terminate access, block traffic, recover reasonable costs, or report violations to authorities or infrastructure providers.
• We cooperate with upstream hosting and infrastructure providers in enforcing acceptable use policies.

7. Intellectual Property

The KlarVPN name, logo, domain names, application code, website content, visual design elements, and related materials are the exclusive property of KlarVPN. You may not copy, modify, distribute, reverse engineer, decompile, or disassemble any part of the Service without prior written consent.

8. Privacy and Data

Your use of the Service is subject to our Privacy Policy, which describes what data we collect, how we use it, and with whom we share it. KlarVPN does not log your browsing history, DNS queries, or IP addresses you visit.

9. Third-Party Services

The Service may contain links to or integrations with third-party websites, applications, or services, including payment processors. You access and use third-party services at your own risk.

10. Disclaimer of Warranties

The Service is provided on an as-is and as-available basis, without warranties of any kind. KlarVPN does not warrant that the Service will be uninterrupted, timely, secure, error-free, available in all locations, or that every defect will be corrected.

11. Limitation of Liability

To the fullest extent permitted by law, KlarVPN shall not be liable for indirect, incidental, special, consequential, or punitive damages. KlarVPN's aggregate liability shall not exceed the greater of the amount you paid in the previous 12 months or $10.

12. Indemnification

You agree to indemnify, defend, and hold harmless KlarVPN from claims, liabilities, damages, losses, costs, and expenses arising from your use of the Service, violation of these Terms, violation of law, or content and data you transmit through the Service.

13. Termination

You may terminate your account at any time through the KlarVPN application settings or by contacting support@klarvpn.com. KlarVPN may suspend or terminate access if you violate these Terms, fail to pay fees, or if required by law or upstream infrastructure providers.

14. Export Controls

You agree not to use the Service to transfer or transmit software, technology, or technical data in violation of applicable export control laws.

15. General Provisions

These Terms, together with our Privacy Policy and any incorporated policies, constitute the entire agreement between you and KlarVPN. If any provision is found invalid, the remaining provisions remain in effect. Notices to KlarVPN should be sent to support@klarvpn.com.
